Hospital fraud, state withdraws charges

Brendon Pillay, the former accountant for Daymed Private Hospital was arrested and charged for allegedly “falsely misrepresenting to various persons that he was a qualified accountant”. He was arrested in Pietermaritzburg and appeared in the Johannesburg Commercial Crimes’ Court on Friday, October 27, 2017. He was initially charged with contravening the Chartered Accountants Act which was later withdrawn and replaced with a charge of suspected fraud. He was released on R20 000 bail.
At the time, Pillay’s lawyer Naren Sangham made representation to the state calling for the charges to be withdrawn against his client.
A week ago, the Deputy Director of Public Prosecution in Johannesburg who is also the regional head of the Specialised Commercial Crime Unit in Johannesburg, Advocate G Nkoana, responded to the application saying he is withdrawing the charges against Pillay.
After “painstakingly” considering the matter, Nkoana found that the complaints made by Daymed against Pillay were made in Pietermaritzburg and therefore should have been enrolled in Pietermaritzburg.
“I agree that the SCCU Johannesburg lacks jurisdiction to accept and/or enrol the matter. The matter must be investigated and decided upon as per Mountain Rise CAS 274/2017,” wrote Nkoana.
Reacting to the SCCU’s decision, Sangham said, “ We had submitted a comprehensive representation to the Deputy Director of Public Prosecution which he ‘painstakingly’ considered and he agreed with me that the charges should be withdrawn. He agreed that the Johannesburg SCCU did not have jurisdiction in the matter.”
“We are now proceeding to institute civil proceedings against the Minister of Police and any other persons who were involved in my client being wrongfully arrested and kept in custody,” said Sangham, adding that his client’s passport and bail money were returned to him.
